Musi Edit Terms of Service

1. General Provisions and Definitions

1.1. These terms of service (hereinafter: the "Terms") define the rules for providing electronic services via the Musi Edit web application (hereinafter: the "Service" or "Platform"), owned and administered by Florian Kurpiela (hereinafter: the "Service Provider").

1.2. A user of the Service can be any natural person, legal entity, or organizational unit that has created an account in the Service and accepted these Terms (hereinafter: the "User").

1.3. The Musi Edit Service is an online tool (SaaS) used to record MIDI messages and audio signals, transpose them in real time, and automatically generate digital sheet music (e.g., in MusicXML format).

2. Technical Requirements

2.1. Proper use of the Service requires:

  • An active Internet connection,
  • A modern web browser (e.g., Chrome, Edge, Safari) supporting the Web MIDI API standard,
  • Appropriate musical equipment (e.g., a MIDI keyboard connected via USB/Bluetooth port).

2.2. The Service Provider is not responsible for the inability to use the Service due to hardware or software limitations on the User's part.

3. User Accounts, Subscriptions, and Payments

3.1. Access to the full functionality of the Service (the "Musi Edit Pro" plan) requires creating an account and paying for a recurring subscription.

3.2. Payments are handled exclusively by an external, certified processor – Stripe, Inc. The Service Provider does not store Users' payment card data.

3.3. The subscription renews automatically at the end of each billing period (e.g., monthly), charging the User's linked payment card.

3.4. In the case of promotional offers (e.g., a reduced price for the first 3 months), the subscription automatically switches to the standard rate specified in the pricing after the promotional period ends.

3.5. The User may cancel the subscription at any time in the account management panel. Cancellation stops the next charge, and the User retains access to Pro features until the end of the paid billing period.

3.6. Due to the digital nature of the service and instant access to the tools, the User consents to the performance of the service before the deadline for withdrawal from the contract, which results in the loss of the right to a refund for the started billing period.

4. Copyrights and Intellectual Property

4.1. The User retains 100% of the copyrights to all melodies, harmonies, and tracks entered and recorded in the Service.

4.2. The Service Provider claims no rights to the generated scores (MusicXML, PDF files) and does not use Users' creations for commercial purposes.

4.3. The Musi Edit software, including its source code, algorithms, graphical interface, and logos, is the exclusive property of the Service Provider and is protected by copyright law. Copying, modifying, and reverse engineering is prohibited.

5. Exclusions and Limitation of Liability (Important)

5.1. The Musi Edit Service is provided "as-is".

5.2. No guarantee of absolute accuracy: The process of converting and quantizing signals into sheet music is based on mathematical algorithms. The Service Provider does not guarantee that the generated score will be 100% error-free or free from rhythmic or harmonic flaws. The Service serves as an auxiliary tool (a musical draft), and the final verification and correction of notes rests with the User.

5.3. The Service Provider is not liable for any damages (including loss of profits, e.g., unrealized composition commissions) resulting from:

  • Operation or errors of transcription algorithms,
  • Temporary unavailability of the Service caused by external server failures (e.g., Vercel, Render) or technical interruptions,
  • Data loss (unsaved recording sessions) resulting from a lack of Internet connection during work.

5.4. The Service Provider's total financial liability on any grounds is limited to the amount of the subscription fee paid by the User in the month in which the event giving rise to the claim occurred.

6. Complaint Procedure

6.1. Any disruptions in the functioning of the Service or billing issues can be reported to the e-mail address: kontakt.musi@gmail.com .

6.2. The complaint notification should include the e-mail address assigned to the account and a detailed description of the problem.

6.3. The Service Provider considers complaints within 14 days of their receipt.

7. Final Provisions

7.1. The Service Provider reserves the right to make changes to the Terms. Users with active subscriptions will be notified by e-mail of significant changes well in advance.

7.2. In matters not covered by these Terms, the provisions of Polish law apply, in particular the Civil Code and the Act on providing services by electronic means.

7.3. Any disputes will be resolved amicably where possible, and ultimately by the common court competent for the seat of the Service Provider.
